Terms and conditions of sale

These terms govern sales made on this site. They are accepted when you place your order. Version in force as of [date de mise en ligne].

1. The seller

Griffon d'art — Arlette Balloni, sole proprietor (EI), 12 rue du Huit Mai 1945, 31780 Castelginest, France. SIRET 822 100 871 00026. Email: griffondart31@gmail.com.

2. The products

The items offered are handmade textile jewelry and accessories, made one at a time in the workshop. There are two families: the one-of-a-kind pieces, already made and sold as they are, and the customized creations, made to order according to your choice of fabric, size and setting.

Photos are provided for illustration only: slight color differences may appear depending on your screen, and they do not constitute a contractual commitment. The preview generated by the configurator is a simulation meant to help you visualize the colors and feel of the fabric; it does not reflect the exact pattern placement on the finished piece. When making your piece, patterns and colors are arranged as harmoniously as possible, unless you tell me otherwise.

Some fabrics, available in limited quantities, may not be offered for items that require a large surface area (wired headbands, belts, neck straps) while still being available for jewelry.

3. Prices

Prices are shown in euros, net of tax. VAT not applicable, article 293 B of the French General Tax Code (Code général des impôts). Shipping costs are added to the price of the products and are shown before the order is confirmed. Prices may be changed at any time, with no effect on orders that have already been confirmed.

4. Order

The order follows these steps: choosing your items and customizing them, reviewing your cart, entering your contact details, choosing the shipping method, choosing the payment method, and then confirming. Confirming the order constitutes acceptance of these terms. A confirmation email summarizing your order will be sent to you.

A comment box is available for any useful details (color preferences, dates when you will be away, special requests).

5. Payment

Payment is made in a single installment, at the time of the order, by bank card (Visa, Mastercard, Carte Bleue), through the secure payment provider Stripe. Banking data is processed directly by the payment provider and is never stored by Griffon d’art. Your order is only made once payment has actually been received.

6. Making and shipping

Orders are generally shipped the same day or the next day. Shipping methods, rates and delivery times are detailed on the page Shipping and delivery times. Shipping is free in mainland France for orders of 79 € or more in products.

Deliveries are made to mainland France, the French overseas departments and territories, Europe and internationally. In the event of a delay caused by the carrier, Griffon d’art will support you with the claim.

7. Right of withdrawal

You have a period of 14 days from the receipt of your order to exercise your right of withdrawal, without having to give a reason, in accordance with articles L221-18 et seq. of the French Consumer Code (Code de la consommation).

Important exception: in accordance with article L221-28 3° of the same code, this right does not apply to goods made to the consumer’s specifications or clearly customized. Creations made to order according to your choices of fabric, size or setting are therefore excluded from the right of withdrawal.

For items covered by the right of withdrawal, please let us know by email at griffondart31@gmail.com, then send the item back within 14 days, unworn and unused. Return costs are at your expense. The refund, which includes the price of the item and the standard outbound shipping costs, is made within 14 days of receiving the return, using the same payment method. A proportional deduction may be applied if the item has been damaged beyond what a simple trial requires.

The practical details are explained on the page Returns and refunds.

8. Legal guarantees

Regardless of any commercial guarantee, the seller remains bound by:

  • the legal guarantee of conformity (articles L217-3 et seq. of the French Consumer Code), which allows you to obtain the repair or replacement of a non-conforming item within a period of 2 years from its delivery;
  • the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code), which allows you to take action within 2 years of discovering the defect.

These guarantees do not cover normal wear and tear, nor damage resulting from improper use or lack of care. Care instructions are given on each product page.

9. Claims and after-sales service

For any question or claim: griffondart31@gmail.com. We encourage you to report any problem in the days following receipt, so that we can act quickly with the carrier; this recommendation does not limit your legal guarantees.

10. Liability

Griffon d’art cannot be held liable for damage resulting from improper use of the items, nor for the consequences of incorrect information provided when ordering (delivery address, measurements, wrist size or waist size in particular).

11. Intellectual property

The designs, photographs and content of the site are protected. Items purchased are for personal use; reproducing them for commercial purposes is prohibited.

12. Personal data

The processing of your data is described in our privacy policy.

13. Consumer mediation

In accordance with article L612-1 of the French Consumer Code, you may use a consumer mediator free of charge to seek an amicable resolution of a dispute, after having first tried to settle it directly with us.

The consumer mediator we fall under is the CM2C (Centre de la médiation de la consommation de conciliateurs de justice), 49 rue de Ponthieu, 75008 Paris, contact@cm2c.net, 01 89 47 00 14. You may file your complaint directly on its platform: www.cm2c.net.

14. Applicable law

These terms and conditions are governed by French law. In the event of a dispute that cannot be resolved amicably, the French courts have jurisdiction. Consumers may bring the matter before the court of their place of residence.
